During course of argument, it is submitted by the learned counsel for the respondents-State that the impugned order dated 09.09.2022, as contained in Memo No. 1466 (Annexure-1), whereby the services of the petitioner has been terminated, is an appealable order and the appeal would lie before the concerned Collector, but the petitioner has not availed the same.

Counsel for the applicant, at this stage, submits that he may be permitted to withdraw this petition giving liberty to the petitioner to make an appeal before the competent authority and, in turn, the competent authority of the Collector concerned is also directed to decide the same within the specific period made by this Court.

4. On the basis of above submissions made by both the counsels, the petition is dismissed as withdrawn and as prayed for by the counsel, liberty is given to the petitioner to make an appeal before the concerned Collector within two weeks from today and in turn, the concerned Collector is also directed to decide the same in accordance with relevant rules and law and other circular governing to the field as early as possible preferably within 30 days from the date of submission of the appeal.
