JUSTICE VINOD KUMAR SINHA ORAL ORDER 06-07-2018 The petitioner is apprehending his arrest in connection with Jehanabad P.S. Case No. 414 of 2017, registered for offences punishable under Sections 366(A), 506, 504 and 34 of the Indian Penal Code.
Allegation against the petitioner is of kidnapping the minor daughter of the informant.
It has been submitted on behalf of the petitioner that that out and out false and frivolous allegation has been levelled, which will appear from the fact that the girl herself has filed petition in the court below stating that she has married with the petitioner and has been living with him and she does not want to pursue the case. Heard learned A.P.P. also.
Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.35034 of 2018 (2) dt.06-07-2018 2/2 circumstances of the case, this application is disposed of with direction to the petitioner to surrender in the court below along with the girl and the court below after verifying the veracity of petition filed by the girl and if the submission of learned counsel for the petitioner is found to be true, he shall release the petitioner on bail to his satisfaction on furnishing bail bonds of Rs. 25,000 ( Rs Twenty Five Thousand), otherwise, he is free to pass any order as he deems fit and proper.
With the above observation and direction, this application is disposed of.
