====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-05-2026 Heard learned counsel for the petitioner and the State.
2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 392 of the Indian Penal Code.
3. Prosecution case, in brief, is that on 18.10.2022 at about 8:30 PM, car of the informant was forcibly stopped by the unknown accused persons. It is further alleged that they assaulted the driver and drove away with the car of informant along with necessary documents and cash.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name transpired during investigation on the basis of confessional statement of coaccused. No stolen article has been recovered from conscious
Patna High Court CR. MISC. No.28529 of 2026(2) dt.04-05-2026 2/2 possession of the petitioner. F.I.R. has been lodged after inordinate delay of about 32 days which itself raises doubt over veracity of the prosecution case.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering backdrop of the case, nature of accusation and delay in lodging the F.I.R., this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jokihat P. S. Case No. 583 of 2022, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
