The petitioners are apprehending their arrest in a case instituted under Sections 366A/34 of the Indian Penal Code. Allegation against petitioners is that they enticed away minor daughter of informant for the purpose of marriage with one Deepak Sahni.

It has been submitted on behalf of the petitioners that they have falsely been implicated in the present case. No allegation of tampering of witnesses is alleged against petitioners. The victim girl has been examined under Section 164 of the Code of Criminal Procedure. She has denied the allegation made in the F.I.R. as far as petitioners are concerned. The 164 Cr. P.C. statement of the victim is at Annexure-2 to the present application. On behalf of the State and the informant, it is submitted that petitioners are named in the F.I.R.

No.51302 of 2016 (2) dt.02-12-2016 2/2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Nautan P.S. Case no. 208 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
