The petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 47, 51, 52, 53 and 54 of the Bihar Excise Amendment Act, 2016.
Learned counsel for the petitioner submits that the alleged recovery was made from the base camp of one M/s Rudra Enterprises Pvt. Ltd. and the liquors so seized are said to be belonging to one Balmiki Singh. Learend counsel for the petitioner submits that only because the petitioner is a partner in the said M/s Rudra Enterprises Pvt. Ltd., his name has been brought in connection with the present case. He further submits that the said recoveries were not made from his conscious possession.

No.54774 of 2016 (2) dt.23-12-2016 P2/2 Considering the nature of allegations and that the petitioner has no criminal antecedent of similar nature, let the petitioner abovenamed, in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Pakridayal P.S. Case No. 114/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
