JUSTICE ASHUTOSH KUMAR ORAL ORDER 23-03-2018 The petitioner/informant has challenged the order dated 10.09.2015 passed by learned Additional District & Sessions Judge, VII, Patna City whereby Shambhu Prasad and his wife Kanchan Devi have been summoned to be witnesses in Sessions Trial No. 731 of 2009, arising out of Alamganj P.S. Case No. 19 of 2008 It appears that earlier also a petition was filed by the prosecution seeking summoning of six more persons as witnesses apart from the witnesses who had already been examined. Those persons were neither injured nor their statements were recorded by the Investigating Officer during the course of investigation of this case. As such, the petition of the prosecution was rejected. Again a petition was filed seeking summoning of the same persons as witnesses to the

Patna High Court CR. REV. No.325 of 2016 (2) dt.23-03-2018 2/2 case.

The Court below, after perusing the records, found that Shambhu Prasad and his wife Kanchan Devi were injured and their injury reports were part of the record. Hence, only they were directed to be summoned for appearing in the witness box. The prayer with respect to other four persons to be summoned was rejected.

This Court finds no fault with the order impugned. The present petition is therefore dismissed.
