This is a petition for grant of anticipatory bail for offence under Sections 272 and 273 of the Indian Penal Code and 47, 51, 52, 53 and 54 of the Bihar Excise (Amendment) Act, 2016. Petitioner is not named in the first information report, but, in course of investigation when the investigating officer went through the partnership deed, it came to light that petitioner is also partner in Rudra Construction Limited and, accordingly, petitioner has been made accused in the present case.

Submission of the petitioner is that co-accused, Akhilesh Kumar Singh and Veena Devi, having more or less similar allegation, have already been granted privilege of anticipatory bail by different Benches of this Court. Petitioner does not have any criminal antecedent.

Considering the aforesaid fact, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand)

Patna High Court Cr.Misc. No.53774 of 2016 (3) dt.09-02-2017 2/2 with two sureties of the like amount each in connection with Pakridayal P.S. Case No. 114 of 2016 to the satisfaction of the Chief Judicial Magistrate, East Champaran at Motihari, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
