The petitioner seeks bail in a case registered under Section 379 of the Indian Penal Code.

Allegation is that on 20.07.2018 the informant after parking his motorcycle near Kunheshwawr Nath Mandir went to Chainpur Bazar for purchasing vegetables and when he came back, he found that his vehicle was not there. It has been submitted on behalf of the petitioner that the petitioner is in custody since 16.08.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. The petitioner is not

Patna High Court CR. MISC. No.27231 of 2019(3) dt.10-05-2019 2/2 named in the F.I.R. The petitioner has got no concern with the motorcycle in question. It is further submitted that the petitioner may be released after completion of one year in custody in the present case from 16.08.2018.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R. The petitioner has got criminal antecedents.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail after completion of one year in custody in the present case from 16.08.2018 on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. IV, Siwan in connection with Siswan (Chainpur O.P.) P.S. case No.142 of 2018.
