The petitioner seeks regular bail in connection with Nautan P.S. Case No. 02 of 2021 instituted for the offences under Sections 413 and 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is in custody since 02.01.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation in the F.I.R. is that the informant alleges that the petitioner on seeing the police tried to flee on his motorcycle but was apprehended and thereafter on being asked to produce the documents relating to the motorcycle, the petitioner was not able to produce the same and disclosed that he has purchased

Learned counsel for the petitioner submits that the petitioner had purchased the motorcycle and was not knowing that it was a stolen one and the person who had sold the motorcycle to him had assured that the documents would be made available to him but before the documents could be handed over to the petitioner, he was apprehended. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that the petitioner is in custody since 02.01.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah in connection with Nautan P.S. Case No. 02 of 2021 subject to the condition as laid down under Section 437 (3) Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
