JUSTICE RAVI RANJAN ORAL JUDGMENT Date: 11-08-2015 Heard learned counsel for the petitioner and the State. It is contended on behalf of the petitioner that though he has been granted all India licence for N.P. Bore Rifle by the competent authority of the State of Jammu and Kashmir while he was posted there as Constable in Central Reserve Police Force and the same was renewed time to time by the said department till the year 2010 which would be apparent from Annexure 1 and, thereafter, he applied for renewal of his licence when he came back to the State of Bihar after his retirement, however, no decision has been taken regarding renewal even after the lapse of five years. A counter affidavit has been filed taking a ground that regarding the verification of licence letters were repeatedly written to

Patna High Court CWJC No.15012 of 2012 dt.11-08-2015 2 / 2 the Home Department of Jammu and Kashmir Government, however, they have not responded. From the copy of the letter, it appears that the same has been written to the Under Secretary of the Home Department, Jammu and Kashmir Government. In my opinion, the addressee should be Secretary of the Home Department, Jammu and Kashmir.

Accordingly, this writ application is being disposed of with a direction to the District Magistrate, Rohtas (Sasaram) to take steps for getting the verification done from the Jammu and Kashmir Government by writing a fresh letter to the Secretary, Government of Jammu and Kashmir which should be sent by the Speed Post, setting out all the details with a copy of the licence of the petitioner and take immediate steps after receipt of such verification report. While doing so he would send copy of Annexure 2 which is the earlier verification report of the Home Department of the State of Jammu and Kashmir. If nothing happens within six months after the receipt/production of a copy of this order, then the petitioner would be at liberty to move afresh.
