JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 28-06-2018 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Bakhtiyarpur P.S. Case No.65 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 307, 427, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioners submitted that there is case and counter case. There is no allegation of assault against petitioner no.1 Dhanoj Yadav, petitioner no.2 Amrendra Yadav is alleged to have used bricks whereas petitioner no.3 is alleged to have assaulted with Farsa to Sagar Yadav and Nitish Yadav, but their injury report suggest that they had sustained simple injury

Having regard to the submissions made above, in the event of arrest or surrender in the court below within six weeks from today, the petitioners are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S.
