JUSTICE BIRENDRA KUMAR ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468 and 471/34 of the Indian Penal Code.

Allegation is that from the bank account of Referral Hospital, Barbigha Rs.1,87,000/- (rupees one lac and eighty seven thousand) was transferred in the bank account of this petitioner standing in Allahabad bank through a clone cheque. The FIR reveals that there is allegation against others also to have withdrawn money from the different account through clone cheque.

After hearing the parties and considering the nature of allegation, I am not inclined to enlarge the petitioner on

Patna High Court Cr.Misc. No.53073 of 2016 (3) dt.23-03-2017 2/2 anticipatory bail in connection with Barbigha Police Station Case No. 09 of 2016 pending in the court of learned Additional Chief Judicial Magistrate, Sheikhpura/successor Court. Hence, prayer for bail is refused.
