Petitioner apprehends arrest in connection with S.T. Excise Case No. 358 of 2018 arising out of Birpur P.S. Case No. 116 of 2018 registered for the offence punishable under section 414 of the Indian Penal Code and under section 30(A) of Bihar Prohibition and Excise Act, 2016.

Learned counsel appearing for the petitioner submits that petitioner has been implicated in the present case on the basis of confessional statement of the co-accused. Nothing has been recovered from the conscious possession of this petitioner. Petitioner is a man of clean antecedent.

Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, let the

No.35042 of 2018(2) dt.19-06-2018 2/2 petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J. IInd Cum Special Judge, (Excise) Supaul in connection with S.T. Case No. 358 of 2018 arising out of Birpur P.S. Case No. 116 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
