The petitioner apprehends his arrest in Barun P.S. Case No.75 of 2019 registered under Sections 379, 420, 411 and 34 of the Indian Penal Code and under Sections 4 and 40 of BMMCR and under Section 15 of Environment (Protection) Act.

The Enforcement Officer seized two vehicles; one truck and another tractor and alleged that both vehicles were indulged in illegal mining the sand and transporting the same. The vehicles loaded with sand were seized.

Learned counsel for the petitioner submits that the petitioner is the owner-cum-driver of the tractor. The petitioner was transporting the sand on valid permit which is annexed as Annexure 3 to this bail petition.
