The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341,323,325,307,506 and 379/34 of the IPC.

The prosecution case as per the written report of the informant Vijay Thakur is to the effect that the accused persons abused and assaulted the daughter of the informant. When the informant, his son and wife went to save her, they were also assaulted by the accused persons.

It is submitted by learned counsel for the petitioners that the impugned order which has been passed after going through the case diary, reflects that the informant received only

Patna High Court Cr.Misc. No.59896 of 2017(2) dt.12-12-2017 2/2 superficial simple injury. Petitioner no. 5 is the own brother of the informant and petitioner nos. 1 to 4 are family members. In the background of the family dispute the accusation has been levelled. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Considering the relationship between the informant and the petitioners, the nature of injury as the impugned order suggests, coupled with the statement made in paragraph 3 of the petition that the petitioners have no criminal antecedent, let the petitioners above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-6, Sitamarhi in connection with Parihar P.S. Case No. 140 of 2017.
