JUSTICE MOHIT KUMAR SHAH ORAL ORDER 01-10-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.
Heard the learned counsel for the petitioner and Sri Alok Ranjan, learned AC to AAG 5 appearing for the State. The present writ petition has been filed seeking following reliefs :- "(i) For issuance of an appropriate writ in
Patna High Court CWJC No.12230 of 2021(2) dt.01-10-2021 2/3 the nature of certiorari for quashing the order as contained in memo no. 1304 dated 19.12.2020 issued under the signature of the Sub Divisional Officer, Siwan Sadar, by which the beneficiaries of Public Distribution System shop of PACS, Sakra, Block Zeeradei, District-Siwan has been tagged with another shop.
(ii) For issuance of an appropriate writ in the nature of mandamus for commanding and directing the respondent authorities concerned to allow the petitioner to continue his License no. 153 of 2016 of Public Distribution System of PACS, Sakra, Block Zeeradei, District-Siwan without any hindrance.
(iii) For issuance of an appropriate writ in the nature of mandamus for commanding and directing the respondent authorities concerned to allow the petitioner to continue as Manager and conduct P.D.S.
shop of Sakra PACS without any hindrance on the ground that the petitioner has regularly distributed the food grains as well as Kerosene Oil.
(iv) For issuance of an appropriate writ in the nature of mandamus for commanding and directing the respondent authorities concerned to pass an appropriate and speaking order on the representations of

The learned counsel for the petitioner, at the outset, seeks liberty on behalf of the petitioner to file appropriate representation before the Sub-Divisional Officer, Sadar, Siwan for redressal of his aforesaid grievances.
The learned counsel for the respondent State has got no objection.
Accordingly, the present writ petition stands disposed of as not pressed, however with liberty to the petitioner to file appropriate representation regarding his aforesaid grievances before the Sub-Divisional Officer, Sadar, Siwan and in case, such a representation is filed within a period of four weeks from today, the same shall be considered and disposed of, in accordance with law, within a period of eight weeks, thereafter.
