The petitioner seeks bail in anticipation of his arrest in connection with Darbhanga Sadar P.S. Case No. 157 of 2016 dated 11.04.2016 instituted for the offences under Sections 341, 323, 379, 504, 354 and 34 of the Indian Penal Code.
The petitioner is the brother-in-law of the informant and there is a pending dispute between the families of the husband of the informant and the petitioner. The allegations levelled in the FIR, it has been argued, is only for the purposes of troubling the petitioner for silencing him from raising any further issues in the family dispute.
There is a counter version of the occurrence as
Patna High Court Cr.Misc. No.42083 of 2018(2) dt.20-07-2018 2/2 well which has been lodged by the daughter-in-law of the petitioner against the informant and others vide Darbhanga P.S. Case No. 152 of 2016.
Regard being had to the nature of accusation and the relationship of the parties, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Darbhanga in connection with Darbhanga Sadar P.S. Case No. 157 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
