JUSTICE PRABHAT KUMAR JHA ORAL ORDER 22-09-2020 Heard learned counsel for the petitioner and Mr. Ajay Kumar Jha, learned Additional P.P. through video conferencing. The petitioner who is in custody since 19.05.2020 seeks bail in Rosera P.S. Case No.139 of 2020, registered under Sections 272 and 273 of the Indian Penal Code and under Section 30(a) of the Bihar Prohibition and Excise Act. The informant made allegations in the FIR that the petitioner had kept liquor in orchard and from there 33 litres of country made liquor and 20 Kgs. of Mahua were recovered. The petitioner is in jail since 19.05.2020. The petitioner has already remained in jail for more than four months.

Considering the facts aforesaid, petitioner, namely, Mohan Sah @ Mohan Kumar Sah @ Mohan Saw is directed to

Patna High Court CR. MISC. No.25114 of 2020(2) dt.22-09-2020 2/2 be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ-II-cum-Special Judge, Excise Act, Samastipur in connection with Rosera P.S. Case No.139 of 2020.
