JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2020 Heard learned counsel for the petitioner and learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in Naubatpur P.S. Case No. 245 of 2020 registered for the offence under Sections 30(a), 38 & 41 of Bihar Prohibition and Excise Act. As per the prosecution case, 2108.805 liters of foreign liquor has been recovered from the R.O. plant of Md. Rasul and two persons namely Awadhesh Kumar and Dukhan Manjhi were apprehended on the spot, and on their disclosure, petitioner and others have been made accused in this case.
It is submitted on behalf of petitioner that nothing has been recovered from the possession of the petitioner. Recovery has been made from the R.O. plant of co-accused Md. Rasul and petitioner has got no concern either with co-accused Md. Rasul
Patna High Court CR. MISC. No.29265 of 2020(2) dt.05-12-2020 2/2 or seized liquor. Petitioner has got clean antecedent, as stated in paragraph - 3 of the petition.
Considering the aforesaid facts and circumstances, the bail application of petitioner is allowed. In the event of his arrest or surrender within a period of eight weeks from the date of receipt/production of copy of this order, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Patna in connection with Naubatpur P.S. Case No. 245 of 2020, subject to condition as laid down under Section 438(2) of the Cr.P.C.
