The petitioner, namely, Arvind Sah apprehends his arrest in prosecution report no.C2A-202/2016 under Section 47(a) of the Excise Act.

The learned counsel for the petitioner submitted that whatever country made liquor i.e. about 70 liters, was recovered from the poultry farm of co-accused Awadhesh Ray and Awadhesh Ray has already been granted anticipatory bail by this Court in Cr. Misc. No.40047 of 2016.

In view of the above fact that the co-accused has already been granted anticipatory bail from whose poultry farm

Patna High Court Cr.Misc. No.41820 of 2016 (2) dt.06-10-2016 the allegation is that liquor was recovered.

Considering the above facts, I direct the petitioner named above to surrender before the court below within one month from today and on his so surrendering, the court below is directed to release the petitioner on bail on furnishing bail bond of Rs.5,000/-(Rupees five thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Hajipur at Vaishali in connection with prosecution report no.C2A-202/2016.
