The present writ application has been filed for the purpose of further investigation in connection with Sahajitpur P.S. Case No. 47 of 2019 lodged under Sections 302/ 34 of the I.P.C. read with Section 27 of the Arms Act.
Counsel for State submits that this case may be disposed off in the light of order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 and
Patna High Court CR. WJC No.305 of 2021(2) dt.21-03-2023 2/2 analogous cases decided on 09.09.2022.
In this view of the matter, the present criminal writ petition is disposed off with direction that the petitioner may seek remedy in the light of order passed in Surendra Singh Vs. The State of Bihar & Ors. in Cr. WJC. No. 153 of 2017 and analogous cases decide on 09.09.2022 within four weeks' from today before the Superintendent of Police, Saran at Chapra.
