====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-11-2017 Heard learned counsels for the petitioners and State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 379, 411 and 120B of the IPC.

The prosecution case got initiated on the direction of the Circle Officer, Barun, who directed the In-Charge Circle Inspector to go to Baba Brick kiln, Jogia, where In-Charge, Circle Inspector found that coal was being unloaded from two trucks. The drivers of the trucks namely, Arjun Kumar Choudhary and Deepak Yadav conveyed to the informant that coal was being unloaded on the direction of the owner of the brick kiln, Sunil Kumar Mehta (the petitioner). From perusal of the papers, it appears to the informant that coal was loaded at Piparwar Colliery and it was to be unloaded to Chatra.

Patna High Court Cr.Misc. No.51631 of 2017(2) dt.13-11-2017 2/2 It is submitted by learned counsel for the petitioner that the petitioner is the owner of the brick kiln. There is no documentary evidence that the coal was purchased by the petitioner or the petitioner had directed for unloading the same. Though, the coal was being unloaded near the brick kiln of the petitioner, but the petitioner was not present there. The investigation is still pending.

Considering the thrust of accusation against the persons who brought the trucks to the brick kiln, let the above named petitioner be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in connection with Barun P.S. Case No. 18 of 2017, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
