In paragraph 5, they have indicated that the petitioner was found to be colour blind in the medical test, therefore, declared unfit and that was the reason for nonappointment of the petitioner on the post of a Constable General Duty.

Petitioner was also informed by the Medical Board about his medical unfitness and a right for filing of review was also given to him. However, till date, it is the stand of Union of India that no review application has been filed. In view of the same, no direction can be given for his appointment, especially when no
