JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-08-2024 The present writ petition has been filed seeking following relief:- "(i)For issuance of an appropriate direction to the respondents concerned to remove the encroachment made over the Public Land (Gali) appertaining to Khata No. 665, 662, Khesra No. 113, 971, 202, 963, 962, 946, Mauza-Pawai, Thana No.147, P.S.-Pipariya, DistrictLakhisarai, by the encroachers, in view of the order dated 26.03.2013 passed in Encroachment Case No. 01/2012-2013 in view of the order dated 17.10.2011 passed in C.W.J.C. No. 6400/2010 and the various orders passed in M.J.C. Case No.1444/2012 and further issue appropriate direction to the learned Additional Collector, Lakhisarai to conclude proceedings of the Encroachment Appeal bearing Appeal No. 113/2013, filed by one Chandra Shekhar Singh

At the outset, the learned counsel for the respondents-State seeks to file supplementary counter affidavit on behalf of the District Magistrate, Lakhisarai, as also the supplementary affidavit on behalf of the Superintendent of Police, Lakhisarai, copies whereof have already been filed online. Let the same be kept on record.

3. It is submitted by the learned counsel for the respondent-State, by referring to the aforesaid supplementary counter affidavits, that the encroachment in question has now been removed in its entirety, hence the grievances of the petitioner has stood redressed.

4. In view of the aforesaid, the learned counsel for the petitioner submits that if it be so, the present writ petition be disposed off.

5. Accordingly, the present writ petition stands disposed off.
