In this case, the petitioner is apprehending her arrest in connection with Bakhtiarpur P.S. Case No. 157 of 2017 registered for offences under sections 366(A)/34 of the Indian Penal Code and subsequently added Section 376/511 of the I.P.C. and Section 8 of the POCSO Act.

As per allegation, the petitioner had given a call that she would go along with the victim girl to the market, the venue was fixed, when the victim gone to the market, the petitioner was missing and there two persons, namely, Jairam Bhagat and Lalu Bhagat were there and they forcefully lifted the girl and took her with them and kept in a room. Later on, the victim girl was released at Bakhtiyarpur.

No.37449 of 2018(2) dt.05-07-2018 2/2 Learned counsel for the petitioner submits that it was mere a chance that she could not reach there and the two persons, named in the First Information Report as also in the statement of the victim girl under Section 164 Cr.P.C., have misbehaved with the girl.

Looking to the entire facts and circumstances of the case, let the petitioner, namely, above named, in the event of her arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, 1st, POCSO, Saharsa in connection with Bakhtiarpur P.S. Case No. 157 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioner for investigation/interrogation, she will remain present and if she would not present herself, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
