JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 08-04-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner apprehends her arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 138 of N.I. Act. The allegation against this petitioner is that she in collusion of her husband took huge amount of money from the complainant for getting sale deed executed but grabbed the entire money.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place.

The allegation levelled against the petitioner is not specific rather general and omnibus in nature. There is specific allegation against the husband of the petitioner. Petitioner is simple house wife and she has no concern with the day to day affairs of her huusband. She has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of her arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Complaint Case No. 1751 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
