The petitioner apprehends his arrest in Khagaria Mahila P.S. Case No.05/2018 registered under Sections 376/511 of the Indian Penal Code.

The victim made allegation that the petitioner forcibly entered into her house and made an abortive attempt to commit rape.

Learned counsel for the petitioner submits that the allegation made in the F.I.R. is quite improbable. The petitioner is next door neighbour of the victim. Nobody supported the allegation made by the victim but it appears that the victim made specific allegation that it was the petitioner who entered into her house and made abortive attempt to commit rape.

Patna High Court Cr.Misc. No.34714 of 2018 (2) dt.03-07-2018 2/2 Considering the aforesaid fact, I am not inclined to enlarge the petitioner on anticipatory bail.
