====================================================== CORAM: HONOURABLE MR. JUSTICE RAJESH KUMAR VERMA ORAL ORDER 04-05-2026 Heard Mr.Rajesh Kumar Sinha, learned counsel for the petitioner and Mr.Ram Naresh Ray, learned A.P.P. for the State.

2. The petitioner seeks bail, who is in custody since 08.07.2025 in connection with Sessions Trial No. 2310 of 2025 arising out of Alamganj P.S. Case No. 366 of 2022, F.I.R. dated 12.05.2022 registered for the offence punishable under Sections 302 of IPC and Section 27 of the Arms Act.

3. Allegation against the petitioner is that he has fired upon the son of the informant on his chest as a result of which he died.

4. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. The

Patna High Court CR. MISC. No.29687 of 2026(2) dt.04-05-2026 2/3 allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. Further submits that it appears from the FIR that the informant is not the eye witness of the alleged occurrence and merely on the basis of suspicion the petitioner has been made accused in the present case.

Learned APP for the State on the other hand has vehemently opposed the prayer for bail of the petitioner and submits that from a bare perusal of the FIR it appears that there is direct and specific allegation against the petitioner is that he has fired upon the son of the informant on his chest as a result of which he died. Further submits that the witnesses have fully supported the case of the prosecution and witnesses stated that the petitioner has fired upon the son of the informant.

6. Considering the nature of allegation against the petitioner in the FIR supported by the witnesses and there is direct and specific allegation against the petitioner, I am not inclined to enlarge the petitioner on bail in connection with Sessions Trial No. 2310 of 2025 arising out of Alamganj P.S. Case No. 366 of 2022, pending in the court of learned Additional Sessions Judge- III, Patna City.
