The petitioner is apprehending his arrest in connection with POCSO Case No. 07 of 2018, arising out of Mahila P.S. Case No. 04 of 2018, registered for offences punishable under Sections 354(D), 376, 511 and 34 of the Indian Penal Code. Allegation against the petitioner is that the petitioner along with other accused persons assaulted the daughter of the informant aged about 13 years and try to outrage her modesty. Submission of the learned counsel for the petitioner is that her statement was recorded under Section 164 of Cr.P.C. in which he has not named this person as the person who tried to outrage of her modesty.

No.34970 of 2018 (2) dt.06-07-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District Judge, 1st cum Special Judge, Nawada, in connection with POCSO Case No. 07 of 2018, arising out of Mahila P.S. Case No. 04 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
