Heard.

Petitioners apprehend their arrest in connection with Araria P.S. Case No. 251 of 2016 registered under Sections-366, 370, 370(A)/371, 120(B) of the Indian Penal Code. The present case has been lodged on the basis of complaint petition which goes to show that it was co-accused Vivek Kumar, who is said to have kidnapped informant's wife but the learned counsel for petitioners submits that the statement of victim has been recorded u/S 164 of the Cr. P.C. in which, she denied the story of kidnapping. The victim was major at the time of alleged occurrence.

Considering the above-said facts and circumstances of

Patna High Court Cr.Misc. No.43551 of 2016 (3) dt.30-11-2016 2/2 the case as well as submission of the parties, this anticipatory bail petition is allowed and it is ordered that the petitioners named above, in the event of his arrest or surrender in the court below within four weeks from the date of receipt/production of copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Araria P.S. Case No. 251 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Araria subject to conditions as laid down u/S 438(2) of the Cr.P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
