Petitioner apprehends his arrest in connection with Complaint Case No.410(C) of 2015 for the offence punishable under Section 323, 467, 468, 420, 120(B)/34 of the Indian Penal Code in which cognizance has been taken under Section 420 of IPC.

The allegation against the petitioner as per the complaint is that the complainant wanted to purchase 22 acres 60 decimal of land at Mauja-Dahua, Thana and Anchal-Bounsi, District- Banka belonging to the petitioner and petitioner executed Zarbyananama after taking a consideration amount of Rs.13,85,000/-. No.26378 of 2019(6) dt.23-08-2019 2/2 been alleged that land was disputed and title suit was pending but the petitioner intentionally did not provide the details of title suit to the complainant. It appears that matter was referred for Mediation before the Patna High Court Mediation Centre and report of learned Mediator dated 19.08.2019 as well as the terms and conditions of agreement entered into between the parties are on record and from perusal of the report-agreement between the parties dated 19.08.2019, it appears that both the parties have amicably settled their dispute before the learned Mediator.

In that view of the matter and taking into consideration the fact that matter has been resolved in Mediation, let the petitioner, above named, be directed to surrender before the learned Court below within a period of four weeks from today and in the event of surrender by him, he shall be released on anticipatory bail by the Court below upon furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-IV, Munger, subject to the terms and conditions as mentioned in the agreement dated 19.08.2019 entered into between the parties before the learned Mediator. sanjeev/- (Anil Kumar Sinha, J) U T
