The petitioner apprehends his arrest in Khizarsarai P.S. case No. 69 of 2016 under Section 353 and other Sections of the Indian Penal Code.
The informant named the petitioner and others and alleged that one Javed has constructed stairs on the public land causing inconvenience to others and on account of such members of the two communities clashed with each other. It is further alleged that petitioner along with other accused persons also participated in the occurrence.
The learned counsel for the petitioner submits that no specific allegation is made against the petitioner. The petitioner has no manner of concern with the occurrence and similarly
Patna High Court Cr.Misc. No.55603 of 2016 (2) dt.12-01-2017 2/2 situated accused persons, namely, Mukesh Singh and others, Sanjay Paswan and another have been granted anticipatory bail vide orders passed in Cr. Misc. Nos. 37629 of 2016 and 50867 of 2016.
Considering the facts aforesaid and the nature of allegations made against the petitioner, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Gaya in Khizarsarai P.S. Case No. 69 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
