This is an application for anticipatory bail in Trial No. 2315 of 2018, arising out of Complaint Case No. 1051 of 2018, disclosing offences under Sections 498A of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. The petitioners are mother-in-law and father-in-law of the husband of the informant.
Learned counsel for the petitioners has submitted that ornamental allegation has been made in the complaint petition of demand of dowry and torture, mainly because of matrimonial
Patna High Court CR. MISC. No.26403 of 2019(2) dt.23-04-2019 2/2 dispute between the complainant and her husband. Considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned S.D.J.M., Sadar, East Champaran at Motihari in Trial No. 2315 of 2018 arising out of Complaint Case No. 1051 of 2018, subject to the condition as laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
