2. The petitioner has prayed for bail in connection with Gidha P.S. Case No. 138 of 2024 registered for the offence punishable under Sections 310(4), 310(5) and 317(5) of the Bihar Nyaya Sanhita and Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. The case of the prosecution is that from the possession of this petitioner, one mobile and small knife was recovered.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has

It has also been submitted that there is no evidence to show that the petitioner was indulged in the present occurrence or was preparing for that. Petitioner is languishing in judicial custody since 24.09.2024.

5. The application for bail is opposed by learned APP for the State and he submits that the petitioner has got criminal antecedent of three cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bhojpur at Ara/Concerned court in connection with Gidha P.S. Case No. 138 of 2024.
