The petitioner apprehends his arrest in connection with Chand P.S. Case No. 78 of 2016, registered for the offences punishable under Sections 341, 323, 354, 307, 504/34 of the Indian Penal Code.
At the very outset, it is submitted that in this case there are seven accused persons out of them five accuse persons have already been granted pre-arrest bail vide Cri. Misc. 38343 of 2016 by order dated 19.09.2016 and on that ground the petitioner also deserves sympathetic consideration as the case of the petitioner is also similar to those of co-accused. In the facts and circumstances as stated above, considering the ground, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Chand P.S. Case No. 78 of 2016 (G.R. No. 1777 of 2016), subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
