2. The petitioner has prayed for bail in connection with Alauli P.S. Case No.146 of 2024 registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act, Sections 10, 13, 17 and 18 of UAP Act. Later on Section 387, 389 and 504/34 have also been added.
3. The case of the prosecution is that from the possession of this petitioner maubadi literature and pamphlets were recovered and on his confessional statement, six country made pistols and ten live cartridges were recovered from Ram Balak Yadav and Alok Kumar Saxena.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.30410 of 2025(2) dt.20-05-2025 2/3 petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. It has further been submitted that though in the confessional statement of this petitioner it has come that he was having the maubadi literature and pamphlets. During course of trial, Sikandar Singh the owner brick kiln has been examined and in his deposition, he has turned hostile. Other brik kiln owner Anuj Singh has also been declared hostile. It has also been submitted that Rambalak Yadav and Alok Kumar Saksena @ Chandan Yadav from whose possession the arms were recovered have been granted bail by this Court vide order dated 04.03.2025 passed in Cr. Misc. No. 72280 of 2024 and 84428 of 2024. The case of this petitioner stands on better footing. Petitioner is languishing in judicial custody since 06.10.2024.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned
