The petitioner apprehends his arrest in Madhuban P.S. Case No. 93/2016, registered for the offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Sections 47, 51 and 52 of the Excise Act.

The police raided the hut of the petitioner and recovered 18 bottles of Kingfisher bear each containing 650 ml and 09 bottles of Officers Choice blue pure Grain Whisky each containing 180 ml.

Learned counsel for the petitioner submits that small quantity of bear and Indian made foreign liquor were recovered. Considering the facts aforesaid and the fact that bear and
