====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 23-09-2020 Heard Mr. Sharda Nand Mishra, learned counsel for the petitioner and Mr. Bhanu Pratap Singh, learned Additional P.P. through video conferencing.

The petitioner seeks bail in Jadiya P.S. Case No.43 of 2020, registered under Sections 363, 366(A) and 34 of the Indian Penal Code.

The informant disclosed that his minor daughter was missing from his house. During the course of search, it transpired that the petitioner kidnapped his minor daughter for the purpose of marriage.

Learned counsel for the petitioner submits that the victim made her statement under Section 161 as well as under Section 164 Cr.P.C. and she disclosed her age to be 19 years. The victim further disclosed that she voluntarily left her house

Patna High Court CR. MISC. No.25160 of 2020(2) dt.23-09-2020 2/2 and solemnized marriage with the petitioner because she was having love affair with the petitioner for last two years but her parents wanted to marry her with another person. The learned Additional Sessions Judge also took note of all these facts but refused to grant bail to the petitioner.

Taking into consideration the facts that the victim herself disclosed that she voluntarily left her house and solemnized marriage with the petitioner as she was having love affair with the petitioner and the fact that the petitioner is in jail since 22.02.2020, petitioner, namely, Pradeep Risideo is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st, Supaul in connection with Jadiya P.S. Case No.43 of 2020.
