The petitioner seeks bail in a case registered under Sections 395, 398 of the Indian Penal Code.
Allegation is that 15-20 unknown persons came with rud, hasua and other weapons and assaulted the informant and took Rs.32,000/- cash and mobile phone.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 11.01.2019 and has got no criminal antecedent. Charge sheet has been submitted in the case. There is no allegation of tampering of witnesses alleged against the petitioner. Petitioner is not named in the F.I.R. His name has come on the confessional statement of co-accused. The petitioner has not been put on T.I.P. No incriminating article
Patna High Court CR. MISC. No.27140 of 2019(2) dt.25-04-2019 2/2 has been recovered from the possession of the petitioner. Other co-accused have been granted bail vide Cr.Misc.No.19651 of 2019.
On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Banka P.S. case No.867 of 2018.
