2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 366(A) of the Indian Penal Code and Section 8/12 of the POCSO Act.

3. As per prosecution case, the informant alleged that on 9.7.2022 at about 8:00 PM the petitioner abducted his daughter, aged about 16 years.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this cased due to dirty village politics. The victim girl recovered but she did not support the prosecution in her statement recorded u/s 164 of the Cr.P.C. She

Patna High Court CR. MISC. No.31059 of 2023(3) dt.31-07-2023 2/2 further stated that she went with the petitioner to Hyderabad by train where both of them lived together. She did not whisper any complicity of the petitioner and she voluntarily wants to live with the petitioner. The petitioner has got no criminal antecedent as stated in para-3 of the petition. Moreover, he is languishing in judicial custody since 14.7.2022.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Maner P.S. Case No. 476 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII-cum-Special Judge (POCSO Act), Patna.
