02-07-2018 The sole petitioner, who was arrayed as one of the main accused in the F.I.R., apprehending his arrest in Barbigha P.S. Case No. 606 of 2017 registered for offence under Sections 341, 323, 307, 379, 504, 506, 34 of the Indian Penal Code & later on Section 302 of the Indian Penal Code was added, has prayed for grant of anticipatory bail.
It appears that despite the fact that in the F.I.R., there is specific accusation against the petitioner, to the reasons best known to the investigating officer, he was exonerated, however; learned Chief Judicial Magistrate, Sheikhpura (for short "Magistrate") has taken cognizance of the offence against the petitioner. Before the court below, while hearing anticipatory bail petition, the learned court below had examined number of paragraphs of the case diary, from which, it is evident that
Patna High Court Cr.Misc. No.34908 of 2018(2) dt.02-07-2018 2/2 petitioner was one of the main accused.
Considering the fact that it is a case under Section 302 of the Indian Penal Code, in which, petitioner was arrayed as one of the accused and during investigation, though material was collected against him, the police due to one reason or the other exonerated the petitioner, but the learned Magistrate has taken cognizance of the offence, there is no reason to extend the privilege of anticipatory bail.
