Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Uphara P.S. Case No. 34 of 2019, registered for the offence punishable under Section 302/34 of the Indian Penal Code and section 27 of the Arms Act. Earlier the bail application of petitioner was rejected vide order dated 05.11.2020. Vide order dated 11.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'R'), which reveals that case is fixed for evidence.

Considering the nature of accusation and stage of trial, I am not inclined to enlarge the petitioner above-named on

Patna High Court CR. MISC. No.38655 of 2021(3) dt.22-09-2021 2/2 bail. Accordingly, the same is rejected.
