BAJANTHRI) 29-11-2023 The present MJC-contempt petition is filed for noncompliance of the order dated 13.01.2022 passed in CWJC No. 13137 of 2021.
2. Direction is for the petitioner to submit a detailed
Patna High Court MJC No.935 of 2022(4) dt.29-11-2023 2/3 representation and, thereafter, the concerned Collector-cumDistrict Magistrate, Saran at Chapra was directed to consider the petitioner's representation within a period of three months from the date of receipt of such representation. Petitioner had submitted representation on 28.01.2022 followed by reminder on 21.03.2022. On the other hand, Opposite Party No. 2 - Collector-cum-District Magistrate, Saran at Chapra has slept over the matter till 14.02.2023, the date on which petitioner's representation was rejected. There is no explanation. That apart, there is no application in seeking extension of time to complying the orders of this Court dated 13.01.2022 passed in CWJC No. 13137 of 2021. There is a delay of about eight months in complying the order.
Therefore, the respondent has committed contempt. Instead of initiating contempt of Court proceedings under Rule 7(i) read with Form 1 of Chapter XXVIII of Rules of the High Court at Patna framed under the Contempt of Courts Act, 1971 (Act 70 of 1971), we propose to impose cost and drop the contempt proceedings. Cost has been quantified at Rs. 10,000/- (Rupees Ten Thousand Only). Cost shall be paid to the petitioner within a period of two months from the date of receipt of this order.
3. With the above observations, the present MJC-
