JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-02-2021 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Supaul P.S. Case No.86 of 2020 for the offence under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

In this case, case diary was called for vide order dated 24.09.2020.

On perusal of the case diary and the materials available on record, the Court is not inclined to grant bail to the petitioner at this stage. Prayer for bail is rejected. However, the court below is directed to expedite the trial and conclude the same at the earliest preferably within a

Patna High Court CR. MISC. No.24816 of 2020(3) dt.05-02-2021 2/2 period of nine months from the date of receipt/communication of a copy of this order.

In the event the trial is not concluded within the time frame as indicated hereinabove, the petitioner may renew his prayer for bail.
