The petitioner is aggrieved by order dated 15.02.2012 passed in Appeal No. 07 of 2011 by the respondent SDO, Katihar, as contained in Annexure-4, whereby the appeal preferred by the respondent no.6 under the provisions of rules framed under Section 48 D of the Bihar Tenancy Act, 1985 has been allowed and order passed by the Anchala Adhikari, Dandkhora has been reversed and set aside.

In the considered opinion of this Court, against the order impugned, the petitioner has an alternative and efficacious remedy before the learned Bihar Land Tribunal, Patna in view of the provisions contained in Section 9 of The Bihar Land Tribunal Act, 2009.

In above view of the matter, the present writ petition

Patna High Court CWJC No.15597 of 2012 (3) dt.01-10-2015 2/2 is dismissed with a liberty to the petitioner to approach the learned Bihar Land Tribunal, Patna for grant of appropriate relief (s) with respect to the lands under dispute.
