====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 30-04-2019 Heard learned counsel for the petitioners and the State.

The petitioners seek bail in Bagha P.S. Case No. 48 of 2019, instituted for the offence under Section (s) 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that informant during patrolling duty received information that three Motorcycles rider were proceeding towards Kumhaiya Banchahari with illicit liquor. The informant along with other Police personnel reached the place of occurrence, On seeing the police party, the accused persons started running away leaving

Out of them, two persons were apprehended who disclosed their names as Dharmendra Yadav (petitioner No. 1) and Om Prakash Kumar Ram. They disclosed that Shyam Bihari Chaudhary (petitioner No. 2) was owner of Kawashaki vehicle. On search, 150 liters of illicit liquor has been recovered from Motorcycles.

Petitioners are in custody since 28.01.2019 having clean antecedent.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, West Champaran at Bettiah, in connection with Bagha P.S. Case No. 48 of 2019, subject to the condition that both the bailors will be the close relatives of the petitioners.
