The petitioner seeks bail in connection with Mahila (Buxar) P.S. Case No. 31 of 2018 (S.Tr. No. 176 of 2018) for the offence under Sections 341, 504, 323, 307 and 376(D) of the Indian Penal Code.

Learned counsel appearing for the petitioner submits the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the victim in her statement recorded under Section 164 Cr.P.C. has stated a different story. On the one hand she has admitted that out of four accused, three of them have committed rape upon her and one Pawan Kumar was

Further she stated in her statement that Pawan and Ranjeet has committed rape on her which is contradictory to the F.I.R. Moreover, the victim has been medically examined on the same day but no sign of rape has been found which is evident from the medical report. The petitioner has been languishing in judicial custody since 09.05.2018.

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge, Buxar in connection with S.Tr. No. 176 of 2018 Mahila (Buxar) P.S. Case No. 31 of 2018. (Arvind Srivastava, J) brajesh/- U T
