2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 310(4) and 310(5) of the Bharatiya Nyaya Sanhita , 2023 .
3 . As per the prosecution case, acting on an information that some miscreants have gathered for committing crime, police reached on the spot and apprehended one person with a pistol and two cartridges while rest of the miscreants including the petitioner fled away from the spot.
4. It is submitted on behalf of the petitioner that no incriminating article has been recovered from the conscious possession of the petitioner. The name of petitioner transpired during course of investigation on the basis of confessional statement of co-accused. Petitioner has got no criminal

5 . Learned counsel for the State opposes the prayer for bail.
6. Considering the aforesaid facts of the case, prayer for bail of all the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let this petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi in Dumra Police Station Case No. 490 of 2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
