Patna High Court MJC No.3136 of 2014 (2) dt.05-07-2016 2/2 the State of Jharkhand, or on behalf of the Union of India. It is submitted by learned counsel for the petitioner that an order has been passed in C.W.J.C. No.2039 of 2009 and 17 other analogous cases including C.W.J.C. No.4375 of 2009 and on noncompliance of the said order within time, the present matter along with the others also stood dismissed.

It is submitted that the direction was simply to file second copy of the brief which was complied belatedly on 13.08.2014. It is also pointed out that the other matters including C.W.J.C. No. 4756 of 2009 have also been restored by order dated 11.02.2016. On a consideration of the facts and circumstances of the case, C.W.J.C. No.4375 of 2009 is directed to be restored to its original file subject to the compliance of the order dated 20.12.2013 passed in C.W.J.C.
