The present application has been filed, on behalf of the petitioner who is the father of the victim, for cancellation of anticipatory bail of opposite party no. 2, granted on 13.01.2017 in connection with Brahmpur P.S. Case No. 171 of 2016 instituted for the offence under Sections 341, 323, 498(A)/34 of the IPC and 3⁄4 of the D. P. Act, on the ground that the victim/daughter of the petitioner is not residing with the opposite party no. 2. It is submitted by learned counsel for the petitioner
Patna High Court Cr.Misc. No.22443 of 2017 (4) dt.11-10-2017 2/2 that the victim was residing with opposite party no. 2 but due to unusual act made by the opposite party no. 2, the daughter of the petitioner was compelled to leave the house of opposite party no. 2.
The petitioner, his daughter and opposite party no. 2 are present in the Court. It has mutually been agreed between the parties that the daughter of the petitioner and opposite party no. 2 will stay together.
Considering the aforesaid facts and circumstances and stand taken by the parties, the present application stands dismissed.
